Man who left ‘threatening’ voicemails had “no intent, and no plan or ability, to follow through,” lawyers argue

Lawyers for a Chicago Heights man who left threatening voicemails are arguing that his actions were influenced by the changing political rhetoric in the United States.

They argue that he should not be lumped in with those who took part in the Capital riots.

According to the Chicago Sun Times, Louis Capriotti, 46, left a voicemail for a member of Congress threatening Joe Biden’s inauguration. The messages said, “motherf***g p***y a** Republicans and these Democrat f**ing terrorists think that Joe Biden is going to put his hand on the Bible and walk into that f***ing White House on Jan. 20th, they’re sadly f***ing mistaken.”

He continued, “We will surround the motherf**ing White House, and we will kill any motherf***ing Democrat that steps on the motherf***ing lawn.” On March 25th, his lawyers asked for a 18 month sentence followed by a 36 month supervised release. The suggestions for his charges range from 30 to 37 months.

In a sentencing memo submitted to federal court Friday, his lawyers said, “He had no intent, and no plan or ability, to follow through on his voicemails.”

Capriotti was arrested six days after the January 6th attack on the Capitol. His lawyers point out that he has no connection to the events that took place that day and was not in the D.C area. The memo states, “Mr. Capriotti’s conduct is in stark contrast to these circumstances that preceded (and likely precipitated) his arrest.”
