Accuser details sexual assault allegations against CNN’s Don Lemon

A man who has accused CNN host Don Lemon of sexual assault has shared details of the incident.

Dustin Hice, 38, has alleged that Lemon, 55, sexually assaulted him three years ago. Hice filed a lawsuit in 2019, but the case wasn’t opened until this year. Fox Host Megyn Kelly had Hice on her show this week, where he shared more details and said he believed Lemon may have acted this way in the past.

In 2018, Hice was working as a bartender at Murf’s Backstreet Tavern in Sag Harbor, which is located in the Hamptons, New York where Lemon owns a home. Hice said he saw Lemon drinking with a group of friends. At this point in the evening, Hice admitted to having finished two or three beers.

He said he went up to the bartender and said, “Hey, Nick, let me get two [vodka] Lemon Drops” and put two fingers in the air, a play on Lemon’s last name. Lemon allegedly responded, “I’m just trying to have a good time, man,” to which Hice said he responded, “Oh, okay,” and walked away.

Hice claimed that a little while later, Lemon walked over to him and “[put] his hands down his board shorts. He [rubbed] himself aggressively.” The suit alleged that Lemon “shoved his index and middle fingers in Plaintiff’s mustache and under Plaintiff’s nose.’’ Hice claimed to recall Lemon saying “‘Do you like p—y or d–k?’ And he kept saying, ‘P or D? P or D?’ He said it three or four times. I’m like, ‘Whoa man, what the hell?’”

While on The Megyn Kelly show this week, Kelly asked if Hice thought this was something Lemon had done previously. “Anybody that acts like that in public without any fear of what it might do to somebody or the consequences it might have, that’s a pattern,” Hice responded.

“I wouldn’t be surprised. He’s protected by the fact that he’s African American, gay man on television and I’m just some nobody.”

Lemon is married to Tim Malone, a New York real estate agent and Hice said he is heterosexual. A CNN spokesperson told USA Today in 2019 that Hice “has previously displayed a pattern of contempt for CNN on his social media accounts. This claim follows his unsuccessful threats and demands for an exorbitant amount of money from Don Lemon.” CNN spokespeople have alleged that Hice is a staunch critic of the network, which was his motivation in filing the suit.

Attorneys for Lemon have alleged that Hice has rid himself of evidence, such as text messages and social media, that would be essential in the suit. In a court filing, Lemon’s attorneys wrote that Hice “repeatedly yelled” to Lemon from across the bar, which Lemon did not respond to. In addition, they said Lennon “is often subjected to racist and homophobic harassment.”
