The National Rifle Association (NRA) filed a lawsuit against the city of San Francisco Monday in response to the city’s Board of Advisors labeling the group a “domestic terrorist organization” last week. The Board, which passed the resolution last week, stated that the NRA “spreads propaganda that misinforms and aims to deceive the public about the dangers of gun violence.” According to NBC News, the suit filed in the U.S. District Court for the Northern District of California in San Francisco alleges that the city’s government violated the NRA’s first amendment rights of free political speech and is being unconstitutional for taking “every reasonable step to limit those who do business with the NRA.” ~
According to The New York Times, the Supervisor of the San Francisco Board, Catherine Stefani, introduced the resolution on July 30 in response to a shooting at a garlic festival in Gilroy, California that left three dead and over a dozen injured. Since that tragedy, mass shootings have occurred in both Texas and Ohio, and calls for broadened and more extensive background checks of gun buyers have become prominent talking points for gun-control advocates. The NRA, which is a gun advocacy organization that works to inform about and lobby for and against gun legislation in the United States, has rejected such calls, and has faced controversy for its authority over the President in such matters. ~
According to NBC News, the association states in its lawsuit that the declaration by San Francisco is blacklisting, and argues that “the government cannot discriminate against citizens based on the viewpoint of their political speech.” Ms. Stefani, however, responded to such outcries by the NRA, stating that “It’s a resolution, it’s not an ordinance, it’s nonbinding,” she said. “This is a desperate move by a desperate organization. They misspend their members’ dues for their personal gain, they have many pending investigations against them, and they continue to perpetuate a culture of sick and pervasive gun violence in this country. Their time is up.” Stefani, who is also a lawyer, believed that her Board’s declaration will withstand legal challenges. ~
